Terms of Service

Please read these terms carefully before using the KämppisFinder service.

1. General

These Terms of Service ("Terms") govern the use of the KämppisFinder mobile application and related services ("Service") provided by HaVe Living Solutions Oy (Business ID: 3554660-1, "Service Provider").

By registering for, accessing, or using the Service, the User ("User") agrees to be bound by these Terms, the Privacy Policy, and any applicable supplementary terms. Users who do not agree to these Terms may not use the Service.

These Terms apply to all Users of the Service, including individual users seeking roommates or apartments and business users such as landlords. In the event of a conflict between these Terms and any separate written agreement between the Service Provider and a business user, the terms of the separate agreement shall prevail.

The Service is primarily intended for use in Finland. Use of the Service from other countries is at the User's own risk and responsibility.

2. Definitions

The following terms have the meanings set forth below when used in these Terms:

  • Service refers to the KämppisFinder mobile application, its related web services, and all features, content, and functionalities offered through them.
  • Service Provider refers to HaVe Living Solutions Oy (Business ID: 3554660-1).
  • User refers to any natural person, entity, or organization that accesses or uses the Service, whether registered or not.
  • Content refers to any material in the Service in any form, including but not limited to profile information, photographs, messages, apartment listings, descriptions, and other data.
  • User Content refers to Content that a User submits, uploads, transmits, or otherwise makes available through the Service.
  • Profile refers to the User's personal profile page within the Service, containing information about the User's lifestyle preferences, housing situation, and other details.
  • Connection refers to a mutual relationship between two Users established through the Service's connection request mechanism.
  • Apartment Listing refers to a listing published in the Service by a landlord or other User advertising available accommodation.

3. Applicability and Formation of Agreement

The use of the Service constitutes acceptance of and commitment to comply with these Terms, the Privacy Policy, applicable laws, and good practice. Use of the Service is prohibited if the User does not accept these Terms.

For registered Users, the agreement between the Service Provider and the User enters into force when the User has submitted the required registration information and thereby registered for the Service. The Service Provider reserves the right to reject any registration without stating a reason.

The agreement between the User and the Service Provider regarding the use of paid features, if any are introduced, shall enter into force when the Service Provider has sent the User a confirmation of their subscription or purchase.

Both the User and, where applicable, the organization represented by the User are jointly and severally responsible for the User's actions in relation to the Service Provider and third parties, including any use of the Service that violates these Terms or applicable law.

4. Service Description

KämppisFinder is a platform that helps students and young professionals find compatible roommates and apartments. The Service includes:

  • Creating a user Profile with lifestyle preferences and housing details
  • Discovering and browsing other Users' Profiles
  • Sending and receiving Connection requests
  • Messaging between connected Users
  • Browsing Apartment Listings

The Service Provider acts solely as a platform provider and is not a party to any agreements, arrangements, or transactions between Users. The Service Provider does not verify the accuracy, legality, or completeness of information provided by Users and is not responsible for the conduct, actions, or omissions of any User.

The Service Provider has no obligation to mediate disputes between Users or to find replacement counterparts in the event that an arrangement between Users does not materialize or is breached by either party.

5. Registration and Account

Use of the Service requires registration by providing accurate and up-to-date information. The User must be at least 18 years of age to register.

The User creates a username (email address) and password during registration. The User account, credentials, and access rights are personal and may not be transferred or disclosed to third parties. The User is responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.

The User must immediately notify the Service Provider of any unauthorized use of their account or any other security breach. Actions performed using the User's credentials are binding on the User until the Service Provider has acknowledged receipt of a notification of compromised credentials.

The User agrees to provide truthful and complete information in their Profile and to update such information without delay when changes occur. The Service Provider reserves the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.

Each individual may only create one account. Creating multiple accounts is prohibited and may result in the termination of all associated accounts.

The Service Provider reserves the right to modify the User's credentials or other information related to the use of the Service if they cause conflicts or duplications in the Service Provider's information systems.

6. Use License and Restrictions

The Service Provider grants the User a limited, non-exclusive, non-transferable, revocable license to use the Service and its Content for the User's own personal, non-commercial purposes in accordance with these Terms. This license grant does not constitute a transfer of ownership of the Content or any copies thereof.

The following restrictions apply to the use license:

  • The User may not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any Content obtained from the Service, except for personal use.
  • The User may not collect parts of the Service or compile them into a separate service or dataset.
  • The User may not use manual or automated software, machines, algorithms, bots, scrapers, spiders, offline readers, or other technical tools to extract data from the Service or its Content without the Service Provider's prior written consent.
  • The User may not use the Service for any commercial activity unrelated to roommate or apartment seeking, unless separately agreed with the Service Provider.
  • The User may not reverse engineer, decompile, or attempt to extract the source code of the Service, unless permitted by mandatory law.

The Service Provider does not grant the User any rights other than those expressly stated in these Terms. Upon termination of the use license, the User must cease all use of the Service and its Content.

7. User Obligations and Conduct

The User agrees to use the Service in accordance with these Terms, applicable laws, regulations, and good practice. The User undertakes to protect and defend the Service Provider, other Users, and third parties, and is fully liable for all costs and damages caused to the Service Provider, other Users, or third parties by the User's use of the Service in violation of these Terms, other contractual terms, or applicable law.

The User shall not:

  • Use the Service for any illegal or unauthorized purpose
  • Harass, threaten, intimidate, or bully other Users
  • Post Content that is defamatory, obscene, hateful, discriminatory, or otherwise offensive
  • Impersonate another person or misrepresent their identity or affiliation
  • Send spam, unsolicited advertising, or promotional material to other Users
  • Collect personal information of other Users for unauthorized purposes
  • Upload Content that infringes the intellectual property rights of others
  • Use automated means (bots, scrapers, etc.) to access or interact with the Service
  • Attempt to circumvent any security measures or access restrictions of the Service
  • Transmit viruses, malware, or other harmful code through the Service
  • Take actions that impose a disproportionate load on the Service's infrastructure

The User is solely responsible for all Content they post, upload, or transmit through the Service, and represents and warrants that such Content does not violate applicable laws or the rights of any third party.

The User is responsible for acquiring and maintaining the devices, connections, and software required to use the Service, and for ensuring that these do not cause harm or disruption to the Service Provider or other Users.

8. User Content

The User retains ownership of all User Content they submit to the Service, including Profile information, photographs, and messages.

By submitting User Content, the User grants the Service Provider a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, copy, modify (e.g., resize images, crop photographs), display, distribute, and publish the User Content solely for the purpose of providing, developing, and promoting the Service. This license terminates when the User deletes their Content or account, except where:

  • The Content has been shared with other Users
  • Retention is required by law
  • The Content has been used in anonymized or aggregated form

The Service Provider reserves the right, but has no obligation, to review User Content (through automated and/or manual means) and to modify, remove, or refuse to publish Content that violates these Terms or applicable law. Profile photos may be subject to automated content moderation to ensure the safety of the Service.

The User represents and warrants that they have all necessary rights to submit all User Content and that such Content does not infringe the rights of any third party. The User shall not assert any claims against the Service Provider based on submitted User Content.

The Service Provider may use User Content for statistical purposes without restriction. User Content may be indexed by search engines, which may cause it to appear in public search results.

9. Privacy and Data Protection

The Service uses cookies and other similar technologies. The Service Provider processes personal data in accordance with its Privacy Policy and applicable data protection legislation, including the EU General Data Protection Regulation (GDPR).

The User acknowledges that certain personal information may be disclosed to other Users as part of the normal functioning of the Service (e.g., Profile information visible to other Users, messages sent through the Service). The User must consider before using the Service that information obtained from or through the Service may not be used in any unlawful manner or for any purpose that would endanger the privacy of individuals.

Personal data obtained through the Service shall be used solely for the purpose of finding roommates or apartments, unless otherwise permitted by applicable law. After the termination of the agreement, the Service Provider shall not disclose other Users' personal data to the User.

10. Connections and Messaging

The Service allows Users to send Connection requests to other Users. A Connection is established when the receiving User accepts the request. Messaging is only available between connected Users.

Connection requests must include a message of 20–500 characters. The Service Provider reserves the right to monitor messages and Connection requests to prevent abuse, ensure compliance with these Terms, and resolve technical issues. By using the messaging feature, the User consents to such monitoring when carried out for justified reasons.

Users may block other Users at any time. Blocking a User removes any existing Connection between the Users and prevents further contact.

Communication between Users through the Service may remain visible in anonymized form after a User deletes their account. The confidentiality of messages transmitted over the open internet cannot be guaranteed.

The Service Provider is not responsible for the content of messages exchanged between Users or for any consequences arising from interactions between Users. The Service Provider has no obligation to deliver or display any messages or Content in the Service if the Service is being used for harmful purposes or in a manner contrary to the purpose of the Service.

11. Apartment Listings

The Service may include Apartment Listings published by landlords or other Users. The Service Provider acts solely as a platform for the publication of such listings and does not verify the accuracy, legality, completeness, or availability of listed apartments.

The Service Provider is not a party to any rental agreements, tenancy arrangements, or other transactions between Users. Users are responsible for independently verifying all details of any Apartment Listing before entering into any agreement.

The User who publishes an Apartment Listing is responsible for ensuring that the listing information is accurate, up-to-date, and that the User has the right to offer the accommodation for the stated purpose. Listing information must be updated without delay when changes occur.

The Service Provider is not liable for any damages, losses, or disputes arising from Apartment Listings or transactions between Users.

12. Fees and Payments

The basic use of the Service is currently free of charge. The Service Provider reserves the right to introduce paid features, subscriptions, or other paid services in the future, as well as to change free features to paid or vice versa.

Any changes to pricing or the introduction of paid features will be communicated to Users in advance. Paid features, if introduced, will require explicit consent from the User before any charges are applied. Price changes do not affect already completed one-time transactions after the Service Provider has received the order.

Current prices and pricing principles, as well as any applicable subscription terms, will be displayed within the Service. All prices displayed in the Service will indicate whether they include value-added tax.

If the User provides incorrect information affecting pricing or billing, the Service Provider may retroactively charge the User based on the actual information.

13. Intellectual Property

The Service and its Content contain material protected by copyright laws and international copyright treaties. The ownership of the Service, as well as all copyrights and other intellectual property rights (including but not limited to copyrights, unregistered and registered trademark and design rights, patents, domain names, trade secrets, and database rights) related to the Service, its appearance, code, and Content, belong to the Service Provider, its partners, or other rights holders.

The Service Provider does not grant the User any direct or indirect rights to any intellectual property through the use of the Service. The saving, publishing, reproducing, distributing, modifying, selling, reverse engineering, vulnerability research, or other exploitation of the Service's Content or any part thereof without the prior permission of the rights holder is prohibited, except for the storage for personal use on a computer or printing as permitted under these Terms.

The User may not, without the Service Provider's prior written consent, use manual or automated software, machines, algorithms, bots, or other technical tools to extract data or create copies from the Service.

The Service Provider and the names of its products and services are trademarks and trade names of the Service Provider. Access to the Service may not be interpreted as the granting of any license or right to use any mark appearing in the Service without the prior written consent of the Service Provider.

14. Reporting Illegal or Violating Content

Users may report Content that they believe to be illegal or in violation of these Terms. When making a report, the User should provide the following information as precisely and substantiated as possible:

  • The reasons why the reporting User considers the Content to be illegal or in violation of these Terms
  • The location of the offending Content (URL or other identifying information)
  • The reporting User's name and email address
  • A declaration that the reporting User is acting in good faith and that the report is truthful

The Service Provider will acknowledge receipt of the report and communicate its decision to the reporting User, along with information about available remedies.

If a User's access to the Service is restricted or their Content is restricted as a result of a report or the Service Provider's own detection, the Service Provider will inform the User of the scope and duration of the restriction, the facts and circumstances on which the decision is based, and the available remedies.

Users who repeatedly submit Content that is clearly illegal or who repeatedly submit manifestly unfounded reports may have their access to the Service suspended.

15. Limitation of Liability

The Service and its Content are provided "as is" and "as available" without any warranties of any kind, whether express or implied. The Service Provider does not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

The Service Provider does its best to ensure the continuous and uninterrupted operation of the Service but does not guarantee the operational reliability of the Service.

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages arising from the conduct, Content, or actions of other Users
  • Damages arising from unauthorized access to or alteration of the User's data
  • Any matters relating to agreements or arrangements between Users
  • Damages arising from technical malfunctions, maintenance, or interruptions in data communications
  • Damages resulting from information or advice provided through the Service

The Service Provider's total liability to the User shall not exceed the amount paid by the User to the Service Provider during the twelve (12) months preceding the claim, or fifty (50) euros, whichever is greater.

The Service Provider shall not be liable for delays or errors caused by circumstances beyond the Service Provider's reasonable control (force majeure), including but not limited to natural disasters, wars, terrorism, epidemics, strikes, lockouts, governmental actions, disruptions in data communications, or failures in third-party services. A force majeure event affecting the Service Provider's subcontractor shall also be considered a basis for exemption.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence. The Service Provider is liable for defects in the Service towards consumers in accordance with the provisions of the Finnish Consumer Protection Act.

16. Security

The Service Provider strives to provide the Service with a high level of security. However, the User acknowledges that the internet is not fully secure in all respects.

The User may not use any devices or programs capable of disrupting the operation of the Service, perform actions that significantly burden the Service's infrastructure (such as mass requests), or interfere with the Service's software and functions. Prohibited actions include placing Content containing viruses, timed malware, or other components capable of affecting the programmatic structure of the Service.

The Service Provider does not provide any warranties regarding the security of the Service. The Service Provider cannot guarantee the security of information transmitted through the Service. The User accepts that the Service Provider is not liable for Content or data sent or received, or not sent or not received, by the User.

17. Service Availability and Modifications

The Service Provider strives to ensure the availability of the Service but does not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond the Service Provider's control.

The Service Provider reserves the right, without prior notice, to modify parts of the Service, correct errors and deficiencies, make other changes to the Service and its Content, and remove parts of the Service. The Service Provider also has the right to restrict the use of certain functions or the Service as a whole without prior notice and without liability for compensation.

The Service Provider will endeavor to keep any interruptions as short as possible and to inform Users of known interruptions and updates in advance where reasonably possible. Significant changes affecting Users will be communicated in advance.

Promotional and other marketing materials do not constitute specifications of the Service.

18. Termination

The User may terminate their account at any time by deleting it through the application settings. Upon account deletion, the User's personal data will be handled in accordance with the Privacy Policy.

The Service Provider may suspend or terminate the User's account if:

  • The User violates these Terms or other applicable terms
  • The User engages in conduct that is harmful to other Users, the Service, or the Service Provider
  • The User's account has been inactive for more than 24 months
  • Continued provision of the Service to the User is no longer feasible for legal or technical reasons
  • There is a justified reason, such as repeated violation of these Terms

In the event of termination for cause, the Service Provider will provide the User with a notification explaining the reason, except where prohibited by law or where notification could compromise an investigation.

Effects of termination: Upon termination of the agreement for any reason, the User's right to use the Service ceases and the User's account is closed. The Service Provider's rights to User Content as described in these Terms shall survive termination. The Service Provider has the right to delete all data concerning the User and all User Content submitted by the User. The Service Provider has no obligation to deliver such Content to the User; the User is responsible for making necessary backups of their own Content.

The provisions of these Terms that by their nature are intended to survive termination shall remain in effect after the agreement ends, including but not limited to provisions regarding limitation of liability, intellectual property, indemnification, and dispute resolution.

19. Assignment

The Service Provider has the right to transfer this agreement to a company belonging to the same corporate group, as well as to the acquiring party in connection with a transfer of business. The Service Provider has the right to assign its receivables to a third party.

The User may not transfer the agreement or their right to use the Service without the Service Provider's prior written consent.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Finland, excluding its conflict of law provisions. These Terms do not limit the rights of consumers under mandatory Finnish legislation.

Any disputes arising from or relating to these Terms or the use of the Service shall first be attempted to be resolved amicably through negotiation. If a dispute cannot be resolved amicably, it shall be settled by the District Court of Pohjois-Savo as the court of first instance.

A consumer User may also bring a dispute before the competent general court of first instance at their place of domicile, and/or refer the dispute to the Consumer Disputes Board (www.kuluttajariitalautakunta.fi). Before referring the matter to the Consumer Disputes Board, the consumer should contact the Consumer Advisory Services (www.kuluttajaneuvonta.fi).

21. Changes to Terms

The Service Provider reserves the right to modify these Terms at its own discretion. Changes to the Terms shall take effect when notice of the changes has been provided in the Service or by email. The User should check the current Terms from the Service's website from time to time.

Material changes will be communicated to Users via the Service or by email at least 30 days before they take effect. Continued use of the Service after the effective date of the modified Terms constitutes acceptance of the changes.

If a consumer User terminates their agreement due to a change in Terms before one week has elapsed from the entry into force of the change, the modified terms shall not apply during the notice period.

If the User does not agree to the modified Terms, they must discontinue use of the Service and delete their account. Any deviations from these Terms for an individual agreement must be agreed upon in writing.
